A semi truck was crossing a road blocking all lanes of traffic in heavy fog while failing to yield the right of way. The plaintiff, who was driving a small car, was unable to see the semi truck and ultimately crashed into it, causing severe skull and facial fractures as well as traumatic brain injuries.
Challenge
The defendants claimed that the driver of the small car was at fault for the accident. They argued that she should have noticed the semi-truck, had failed to turn on her headlights, and was distracted by her phone. Furthermore, they asserted that despite her injuries from the collision, she made an exceptional recovery. She graduated from high school on schedule, attended her preferred four-year college, and completed her degree as expected. The defendants also maintained that she had returned to her normal cognitive function within four months of the accident and had fully recovered from any traumatic brain injury.

Approach
We focused the trial exhibits on the damages side of the case, ensuring the jury understood the significant injuries (both acute and chronic).
The visuals helped the jurors understand the intensity and severity of all the skull and facial fractures. The visuals also helped show the jurors how certain fractures, while "healed", resulted in permanent disfigurement to the Plaintiff's face.
Finally, the brain map visual helped the jurors understand the severity of the traumatic brain injury, including the bleeding inside the brain, leading to holes in the girl’s brain and ultimately dead parts of the girl’s frontal lobe.

Utilizing state-of-the-art medical demonstratives, which included the patient's actual radiographic imaging, Counsel was able to demonstrate the severity of both the acute and chronic injuries as a result of the collision. The result was a $35M verdict.
