The Plaintiff sustained a significant brain injury with subdural hematoma, a frontal calvarial fracture across her skull, interspinous ligament edemas behind her neck, a type III odontoid process fracture, a fractured tibia, and catastrophic compression fractures throughout her thoracic and lumbar spine.
She would spend a week in the hospital, two months in a heavy halo device that held her head in place, and it would be two years before her last head wound would fully heal. The preschool, the city, and the school district all knew 16 months before the incident that falling eucalyptus tree branches in the park adjacent to the daycare posed a dangerous risk to children. However, no one knew whose responsibility it was to remove them.
