A family was driving together in their sedan on a highway on a Sunday afternoon. When traffic slowed, the driver stopped their car. A truck driver approached the car driving a loaded tractor-trailer for his employer (the Defense), traveling the same direction.
Evidence suggested that the truck driver was distracted by use of his cell phone, and failed to slow his tractor-trailer for the stopped traffic. He crashed into the rear of the Plaintiff’s vehicle at high speed.
The biggest challenge in this case was proving that the damages exceeded the available insurance policy limits, and convincing the corporate Defendants to pay in excess of the limits. The exhibits created by High Impact went a long way towards achieving that goal. Unfortunately, the Defendants filed for bankruptcy while this case was pending, at which point results were limited to collecting the layers of available insurance coverage.
