David Yarborough, obtained a $2M settlement for a 68-year-old woman who sustained severe skull and shoulder fractures after she was ejected from a golf cart.
Challenge
The Plaintiff’s golf cart was traveling 25 mph when it ran into a heavy skid-steer loader that was backing out into the road. After being thrown from the golf cart, the Plaintiff landed face-first into the pavement, fracturing her frontal skull and shattering her right shoulder.
The Plaintiff’s medical bills were under six figures and her LCP wasn’t much more, but Mr. Yarborough’s goal was to obtain the entire policy limit by demonstrating the true reality of his client’s injuries beyond what 2D black-and-white X-rays and CT Scans could depict.
To strengthen his demand package, he needed a demonstrative that would bring his client’s injuries to life and maximize the value of non-economic damages, which included pain and suffering, loss of enjoyment of life, and permanent impairment.

Approach
Mr. Yarborough provided our team with his client’s radiography and tasked us with layering them on top of one another to render an accurate 3D model each fracture. We then used those models to create a 3D animated Cinematic Summary of Injuries (CSI) to capture every angle of these fractures in one continuous fly-through that outlined each injury.

Result
Mr. Yarborough’s Neurologist Expert MA White, MD, used the animation in his video testimony as he explained each injury. Mr. Yarabrough provided the video to the Defense in the form of a link that the Defense could click to securely download and observe the video. The case was negotiated pre-suit. After being presented with the visual evidence, the Defense agreed to settle the case for $2M to assist Mr. Yarborough’s client in her long, painful recovery.
