When a truck traveling under the speed limit struck a pedestrian crossing a busy street at dusk, many witnesses blamed the victim. However, Dave Fox, and Chris Hendricks, with Fox Law in Solana Beach, CA knew there was more to the story. Challenge

This case was unique, as the defendant was driving under the 45mph speed limit when they struck the plaintiff crossing the street. Law enforcement found the plaintiff at fault in this incident and issued a report accordingly, which many witnesses confirmed.

The circumstances seemed clear cut at first, however after diving in deeper it was established that there was shared responsibility. The driver had more than enough time to react to the pedestrian and prevent hitting them, and Mr. Fox and Mr. Hendricks needed to prove that their client was not to blame.

Approach

Our team collected exact details about the sequence of events, including the speed of the truck and visibility, in order to put together a cohesive visual animation that:

Showed that the defendant had ample time to react to the plaintiff as she was crossing the street, over the length of a football field.

Compared the circumstances to what the driver of the truck should have done since they had plenty of sight distance and time to stop or change lanes to avoid the collision.

Accurately represent all details that were reported, while highlighting the clear sign of a pedestrian crossing zone ahead.
