Challenge
The injuries the Plaintiff suffered after the crash were a herniated cervical disc and a herniated thoracic disc, yet the Defense disputed damages. The Plaintiff had a degenerative disc disease in other parts of the spine and is a construction worker, however multiple MRIs were performed showing damage done to the spine over the years since the incident. Despite there being no correlation between the client’s disease and his work, the Defense denied liability for the herniations.
