The transfer took three hours, and it was another five hours before a doctor saw him again. During this time, his condition worsened, becoming more delirious and confused. He finally got an MRI – 13 hours after being admitted – which confirmed he was having a posterior circulation stroke and had a vertebral artery dissection in his neck.  

Emergency surgery followed, but complications arose, including bacterial meningitis. The man sued the hospital and doctor for medical malpractice due to irreversible brain damage that disabled him. The case against the hospital and other physicians resolved before trial and the case against the emergency physician and his group proceeded to trial.

Eric Rossman from Rossman Law Group sought High Impact's help for trial exhibits that would support his arguments. 

The defense claimed the man's injuries weren't a result of negligence, arguing they met the care standards and that the complications were unavoidable. Rossman countered that the medical team was reckless in their treatment of the man and if they had met the standard of care, he would not have been disabled from the stroke. The attorney needed help explaining the damage to the brain to a jury with no medical knowledge. Our team of medical illustrators created a series of visuals that detailed the severity of the stroke to the jury. 

The medical illustrations of the CT scans clearly showed that the plaintiff had visible ischemia and infarct in various locations within the patient’s brain. Combined with the man's presenting signs and symptoms, this scan should have indicated to the doctors that he was having a stroke.

The next round of trial exhibits were medical illustrations and colorized films that explained how the torn artery in his neck led to the stroke and the damage it caused. Adding color to the radiology allowed the jury to see the gravity of the injury. One of the demonstrative pieces of evidence showed the progression of cerebellar ischemia and infarct. The misdiagnosis led to him experiencing multiple strokes in the posterior fossa area, which could have been prevented. 

Lastly, we created an interactive presentation that summarized and simplified the plaintiff’s damages. This 360-degree interactive trial exhibit allowed Rossman to educate the jury on the totality of the injuries without overwhelming them.

Using our visual aids, Rossman successfully persuaded the jury that the defense was negligent and reckless with the plaintiff’s treatment, leading to a $13.6 million verdict. This verdict stands as the second-highest jury award in an Idaho medical malpractice case.
